Do you have to wear a seatbelt in the back seat?
In the U.S., seat belt laws for backseat passengers differ from state to state. Currently, 41 states and the District of Columbia require all passengers, including those in the back seat, to wear seatbelts.
Among the pro-seatbelt states,
- 18 states, the District of Columbia, and two territories have primary enforcement for all occupants.
- 5 of these states have primary enforcement for youth.
- 11 states include rear seats as secondary enforcement.

Arizona, Arkansas, Colorado, Florida, Iowa, Missouri, Nebraska, New Hampshire, and Ohio are the states that don’t require seat belts in the back seat. However, almost all states require children under a certain age to wear seatbelts, irrespective of where they are seated.
