Minimum Required Auto Insurance Coverage in Illinois

You are often expected to provide uninsured and under-insured motorists coverage, depending on the insurance restrictions.

Here is the minimum amount of insurance that Illinois drivers need:

Coverage Type Minimum Coverage Limit
Bodily Injury Liability Coverage (per person) $25,000 ($50,000 for injuries resulting in death)

Property Damage Liability $10,000

Cheapest Car Insurance in Illinois for Minimum Required Coverage

The cost of car insurance is significantly individualized. For pricing plans, car insurance insurers depend on details such as age, sex, venue, car model, and driving history. Since the cost of premiums is different for everyone, the cheapest car insurance in Illinois would rely on the customer.

Do I Need More Than the Minimum Required State Coverage in Illinois?

If you have Illinois car insurance, then you must have the following coverages as a bare minimum in terms of car insurance:

  • Bodily injury or death for one person: $25000
  • Bodily injury or death of two people: $50000
  • Property damage: $10000

Comprehensive insurance is not required. We recommend that you get comprehensive insurance coverage if you are involved in a more serious accident requiring extensive repairs and medical fees.

Illinois Car Insurance Laws

Illinois is an at fault state. That is, Illinois uses a 'fault' system when it comes to financial liability for injuries, vehicle damage, and other losses resulting from an automobile accident, Illinois uses a "fault" system. This means that the person who caused the car accident is responsible for compensating anyone injured as a result of the crash (although, in practice, the at-fault driver's insurance company will normally cover these losses, up to policy limits).

In Illinois, a person who is injured or damages their property as a result of an auto accident has three options:

  • By filing a claim with their own insurance company, assuming that the loss is covered under the policy (in this situation, the insurance company will likely turn around and pursue a subrogation claim against the at-fault driver's insurance company)
  • By filing a third-party claim directly with the at-fault driver's insurance carrier, or
  • By filing a personal injury lawsuit in civil court against the at-fault driver.

Note that claimants in no-fault vehicle insurance states do not have the same options. Regardless of who caused the accident, if you are wounded in a car accident in a no-fault state, you must rely on your car insurance coverage to cover medical bills and other out-of-pocket expenses.

You can only go outside of no-fault and file a claim against the at-fault motorist if your claim meets certain statutory standards. However, Illinois drivers do not have to worry about no-fault coverage in an accident that occurs within the state.

Illinois Penalties for Driving Without Car Insurance

You could risk the punishment of at least $500 if you operate a registered vehicle without car insurance in Illinois. If you're spotted driving a car whose registration has been suspended due to a lack of insurance, you'll be fined at least $1,000. Note that these fines will almost certainly be insignificant compared to the financial consequences of not having auto insurance if you are involved in a car accident.

Illinois Auto Insurance Requirements

Illinois stipulates that all vehicles registered in the state must be covered by liability insurance.

Up to the coverage limits, this basic liability coverage pays the medical bills, property damage bills, and other costs of drivers, passengers, and pedestrians who are hurt or whose cars are damaged in a car accident you cause. You can (and in some cases should) carry more coverage to protect yourself in the event of a catastrophic car accident resulting in serious injuries and car damage.

Remember that you are personally responsible for the remaining balance after your policy limits have been reached. Thus larger insurance coverage can assist in protecting your assets in the event of a major accident.

If a member of your family drives your car or if you've permitted someone else to drive it, your liability coverage kicks in. It will almost certainly protect you if you are involved in an accident while driving a rented car.

Finally, keep in mind that liability insurance does not cover your injuries or vehicle damage in the event of a car accident. If you're in an automobile accident and no one else's insurance covers your losses, you'll need alternative (extra) coverage. For example, Personal injury protection (PIP) or MedPay coverage can pay for medical expenditures resulting from an automobile accident. In contrast, collision coverage might pay for repairs to (or replacement of) your damaged car.

Illinois Car Insurance PIP

Personal Injury Protection (PIP) is a type of car insurance that pays for your medical care if you are hurt in an accident, no matter who was at fault. In no-fault states, you have to have PIP coverage. Illinois, on the other hand, is not a "no-fault" state.

So, it's up to you to decide whether you want PIP coverage. PIP coverage is also a choice in Illinois. Even if you caused the accident, PIP insurance would help pay for your medical bills and lost wages. It may even pay for accidents that your health insurance won't cover.

If you have PIP coverage, you'll likely go there first if you get hurt in an accident. But there are limits to what PIP will cover. The most you can be covered for is anywhere from $1,500 to $250,000.

If your medical bills and missed wages add up to more than your PIP limit, you must file a personal injury claim against the driver who caused the accident to get the extra money. You can start making PIP claims with your insurance company as soon as you get medical bills.

You don't have to wait until the end of your treatment. Before they take care of your claim, your insurance company may make you see a doctor of their choosing.

Once you've reached the limit of your personal injury protection limit, you can use your health insurance to pay for more medical care. Remember that if you win a personal injury claim and get money from the other driver, you will have to pay back both your health insurance company and your PIP insurance company.

Auto Insurance Coverage Types

Coverage type What it does
Liability coverage Your legal defense is covered if a lawsuit is filed against you due to an accident. Property damage and bodily injury are two forms of liability coverage that must be included in your insurance policy if you live in Washington.
Property damage If you are held legally responsible for an accident, this policy protects your assets, and it protects you against certain types of harm to another person's property or car.
Bodily injury If you're held legally responsible for an accident, it protects your assets, including some expenses related to bodily harm suffered by the other parties.
Comprehensive When non-collision-related accidents cause physical damage to your car, this sort of Washington auto insurance coverage is used to fix it (subject to deductible).
Collision When your car sustains physical damage due to a collision with another car or item, collision coverage is utilized to fix it (subject to deductible).
Uninsured/underinsured motorist Protects you if the other party is at fault in an accident and either does not have insurance or is underinsured.

Proof of Auto Insurance in Illinois

Failure to show evidence of insurance might result in hefty fines. A random selection procedure is also used in Illinois. The state will ask you to present proof of insurance coverage:

  • When stopped by police officers during routine traffic stops.
  • Using the state's electronic verification scheme, which notifies and requests proof of coverage from random drivers.

If you receive a notification in the mail, you have 30 days to show evidence of insurance. Failure to provide proof within this time frame may result in the same penalties as driving without insurance.

It can be costly to drive without insurance or a license. If you continue to drive while your license is suspended, you may be charged with a class A misdemeanor, which carries a penalty of up to one year in prison and a $2500 fine.

It's also a good idea to be informed of any additional Illinois driving rules. You could face fines and increase your insurance costs if you break these regulations. All drivers in Illinois are prohibited from texting while driving. Drivers cannot chat on their phones or use them while driving. A $75 fine can be imposed if these laws are broken.

Reasons Why Auto Insurance Costs More in Illinois

Many drivers have learned from personal experience that auto insurance costs rise every year. However, a lot goes into determining car insurance rates, and not every region has the same tendencies. There has been a recent trend toward more expensive auto insurance in Illinois. Year-over-year rate adjustments vary greatly by the state due to the complexity of auto insurance pricing.

Insurance companies utilize the location as one of the key rating variables when determining premiums. Auto insurance premiums are influenced by the location and state of a car due to state rules and the varying degrees of risk associated with insuring cars in different parts of the country.

Your car, your driving habits, demographic characteristics, and the coverages, limitations, and deductibles you select are all elements that may influence your auto insurance prices. These considerations could include your age, your car's anti-theft measures, and your driving record.
